Welcome to Dewrito.net (the "Service"), a Matrix protocol homeserver for decentralized, secure, federated communication, along with self-hosted Fluxer instances for real-time instant messaging, VoIP (voice/video calls), screen sharing, and community features (built as an open-source Discord alternative under AGPLv3). By accessing, registering for, or using the Service (including Matrix federation, Fluxer channels, or any interactions), you agree to these Terms of Service ("ToS") and our incorporated Community Guidelines. If you do not agree, do not use the Service.

1. Definitions

  • Service: Our Matrix homeserver (rooms, bridges, bots, federation features) and self-hosted Fluxer chat platform (channels, VoIP, media sharing, moderation tools, and related features).
  • You/User: Any individual or entity using the Service (account holder, community member, or federated participant).
  • Content/User Materials: Messages, files, rooms/channels, media, voice calls, screen shares, custom emojis/stickers, or other data you post, upload, transmit, or generate.
  • Federation: Matrix inter-server communication (e.g., with matrix.org); Fluxer operates on per-instance basis (no native cross-instance federation).
  • Providers: Third parties we use (e.g., PayPal/Stripe for payments, Porkbun for domains, Cloudflare for networking/security).

2. Eligibility and Accounts

  • You must be at least 18 years old with a valid, verified email address.
  • You are responsible for maintaining account security (passwords, credentials). Report unauthorized access immediately.
  • Accounts are personal; community/business use is allowed but must comply with all rules below.
  • We may require identity verification for compliance (e.g., age, payments, legal obligations).

3. Community Guidelines (Adapted from Matrix.org & Fluxer Norms)

We strive for a welcoming, respectful community across both Matrix and Fluxer features. Violations may result in content removal, channel bans, or account suspension. This applies to all rooms/channels, messages, calls, and interactions (and encourages the same in federated Matrix rooms or your Fluxer communities).

Expectations: Be friendly, patient, welcoming, considerate, respectful. Honor diversity (race, gender, orientation, disability, etc.). No discrimination. Resolve disagreements constructively.

Unacceptable Behavior (Harassment includes but is not limited to): Offensive comments on protected characteristics; deliberate misgendering/deadnaming; threats, violence incitement, stalking, intimidation; unwelcome sexual attention or explicit content; sustained disruption, doxxing, outing private info; pattern of inappropriate contact after requests to stop.

We do not act on good-faith boundary-setting, tone complaints, or non-malicious discussion.

Reporting: Use in-client tools (Matrix reports or Fluxer moderation) or email abuse@dewrito.net. Immediate action possible via bots/moderation tools. Reports handled confidentially.

4. Fluxer-Specific Rules (Self-Hosted Chat & VoIP)

Fluxer features are provided for personal, community, or group use (aligned with AGPLv3 open-source licensing). Self-hosting gives full control, but you must follow these rules:

  • Use for lawful, non-abusive communication: text chat, voice/video calls, screen sharing, custom emojis/stickers, roles, etc.
  • Commercial hosting/monetization (e.g., charging for access, premium features, or "Plutonium"-style tiers on your instance) is allowed only if you comply with AGPLv3 (provide source code) and our general prohibited activities (no high-risk businesses).
  • Respect privacy: Do not record calls without consent; enable E2EE where available.
  • Prohibited: Spam/bots flooding channels; generating/sharing CSAM, explicit adult content (banned under general rules), hate speech, threats, or illegal material; circumventing moderation tools.
  • Excessive resource use (e.g., overloading VoIP servers, bulk spam calls) may result in throttling or suspension.
  • Fluxer is provided "as-is"; performance depends on your setup/hardware; no uptime guarantees.
  • You retain control of your instance data but grant us a limited license to store/transmit/moderate shared content as needed.

5. User Conduct, Content, and Prohibited Activities

Use the Service only for lawful purposes. You warrant your Content does not violate these rules and grant us a worldwide, royalty-free license to host, transmit, and moderate it (including Matrix federation or Fluxer instance storage).

Strictly Prohibited (to ensure Matrix/Fluxer compliance, prevent defederation, avoid Provider deplatforming):

  • Any illegal activity (US, UK, EU, local laws): CSAM/child exploitation (proactive scanning/reporting); hate/harassment/threats; fraud; drugs/weapons; human trafficking; suicide encouragement.
  • Spam/phishing/technical abuse: Bulk messages/calls, malware, DDoS, hacking, disrupting federation/other users.
  • Intellectual property violations (DMCA takedowns honored).
  • High-risk/prohibited businesses (PayPal/Stripe compliance): Adult/sexual content/services (porn, AI-generated explicit—including voice deepfakes); gambling; drugs/firearms; crypto mining/ICOs; pyramid schemes; any restricted items.
  • Fluxer/Matrix-specific: Impersonation; bot spam in channels; non-consensual recording/sharing of calls; circumventing bans/filters.
  • Domain/Cloudflare abuse: Phishing, malware, botnets, undue network burden.
  • Other: Exceeding fair usage; violating export laws; false sponsorship claims.

We proactively moderate and may use blocklists or tools. Abuse risks defederation (Matrix) or Provider suspension.

6. Payments (If Applicable)

Paid plans use PayPal or Stripe. Comply with their AUP/Prohibited lists. Fees non-refundable except as required by law.

7. Moderation, Enforcement, and Termination

We may remove Content, suspend/limit/terminate accounts (with or without notice) for violations, legal needs, or risk.

Appeals: support@dewrito.net (no guarantee).

Providers may suspend services independently.

Termination: Access ends; back up your data.

8. Disclaimers and Liability

Service "AS IS"—no warranties (availability, security, federation/VoIP quality).

Not liable for data loss, third-party actions, or indirect damages.

You indemnify us, Providers (Matrix Foundation, PayPal, Stripe, Porkbun, Cloudflare), and affiliates.

No liability for federation decisions or Fluxer community norms.

9. Privacy

See separate Privacy Policy. Data processed per law; Matrix federation shares metadata; Fluxer instances are user-controlled.

10. Governing Law and Disputes

United States law (USA). Class action waiver where permitted.

11. Miscellaneous

Severability; no waiver unless written.
